Privacy Policy

Who we are

Bay Point Advisors, LLC ("Bay Point", "we", "us") is a private credit firm. We offer financing to qualified bidders on assets sold through the auction houses we partner with. This policy explains what information we collect when you use our application portal, how we use it, who we share it with, and the choices you have. It applies to the portal and to the emails and documents we send you in connection with an application.

What we collect

We collect information in three ways.

  • Information you give us. Your name, email address, phone number and mailing address; whether you are applying as yourself or on behalf of an entity, and the entity's name and type; the amount you expect to bid; and the answers you give during the application conversation.
  • Information from identity verification. To verify who you are, we ask you to present a government-issued identity document through our verification provider. The provider keeps the images of your document and any selfie you provide; we receive the result of the verification, the checks it performed, and the name, date of birth, document number and address read from the document. Your date of birth, your document number and, when you provide it, your Social Security number are stored only in encrypted form and are opened only by a named member of our team for underwriting, with each opening recorded.
  • Information from a consumer reporting agency. With your written authorization, given separately during the application, we obtain a consumer credit report about you from Experian for the purpose of pre-qualifying you for financing. This is a soft inquiry and does not affect your credit score. We keep the structured results of that report as part of your file. We do not keep the report as a document.

We also record technical information needed to run the portal securely: the time of your sign-in, the actions taken on your file, and the delivery of emails we send you. We do not use advertising cookies or third-party analytics. The cookies we set are those needed to keep you signed in and to carry an invitation from the link you followed to your application.

How we use it

  • To identify you and confirm that the person applying is the person named.
  • To evaluate your application for financing. Every determination on an application is made by a person at Bay Point; no decision is made automatically.
  • To prepare, send and record the documents you and we sign, such as a term sheet.
  • To write to you about the status of your application, and to reach you when a person on our team needs to.
  • To meet our legal and regulatory obligations, including those that attach to credit inquiries and credit decisions.
  • To keep the portal secure and to keep a record of what was done on your file, by whom, and when.

Who we share it with

We share your information only with the providers who help us do the things above, each under an agreement that limits what they may do with it:

  • Our identity verification provider, which verifies your document.
  • Experian, which furnishes your consumer credit report on your authorization.
  • Our electronic signature provider, which delivers documents for signature and keeps the signing record.
  • Our loan servicing system, which receives the details of a financing once a term sheet is executed.
  • The providers that host the portal, store its data and deliver its email.

We tell the auction house which assets we will finance. We do not tell the auction house that you have applied, or what we determined about you, unless you ask us to or it is needed to complete a transaction you have entered into. We do not sell your personal information, and we do not share it for anyone else's marketing. We may disclose information when the law requires it, to protect our rights, or in connection with a sale or reorganization of our business.

How long we keep it

Records of credit inquiries, of the authorizations behind them and of the determinations we make are kept for as long as the law requires, which is typically several years after the application closes. Other information about your application is kept while the application is open and for a period afterward so that we can answer questions about it. You may withdraw an application at any time from your portal. Withdrawing stops our work and our outreach on it; it does not erase the record, because a credit inquiry we have already made is a record we are required to keep.

How we protect it

Access to your file is limited to the people at Bay Point who work on it, and every view of a sensitive value is recorded. Sensitive identifiers are encrypted with keys that are not stored alongside the data. Documents you upload are checked before anyone can open them. The portal uses single-use sign-in links rather than passwords, so there is no password of yours for us to hold or lose.

Your choices and rights

  • You may decline to provide information; we may then be unable to consider your application.
  • You may decline the credit authorization; without it, we cannot pre-qualify you.
  • You may withdraw your application from your portal at any time.
  • You may ask us what information we hold about you and ask us to correct it.
  • You have rights under the Fair Credit Reporting Act with respect to the consumer report we obtain, including the right to know if information in it was used against you and to dispute inaccurate information with the reporting agency.

Changes to this policy

When we change this policy we will change the effective date above and, where the change is material, tell you through the portal or by email before it takes effect.
